Adverse Possession

Adverse possession is a legal process where individuals can claim ownership of land they have occupied exclusively, continuously and uninterruptedly for greater than 15 years. With an adverse possession application and supporting documents, you may be able to claim legal ownership over land or a portion of land that has been within your boundary fencing for 15 years.

We provide Abstract of Field Records, Plan of Survey and Licensed Surveyors report. Your lawyer or solicitor may complete the application on your behalf and include supporting documents from a Licensed Land Surveyor and submit the application with Land Use Victoria.

In addition to Adverse possession (Sec.60), we can carry out the amendments to the title under the provisions of Transfer of Land Act 1958. The most common dealings are,

provide the appropriate documents required by Land Use Victoria to aid following applications,

  • Amendment of Title under section 99 or 103 of the Act
  • Removal of “Warnings as to Dimensions” under section 26P of the Act
  • Conversion of “Old Law” deeds to Certificate of Title under Section 15 or 26 of the Act
